Wag & Sniff — Terms of Service (U.S.)

1) Acceptance of Terms

By accessing, purchasing from, or using the Wag & Sniff website (the “Site”), you agree to these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, do not use the Site.

2) Eligibility

You must be at least 18 years old (or the age of majority in your state) to purchase.

3) Store Scope

We sell pet accessories, including items that may be personalized (e.g., engraving, custom names). Personalized items are typically final sale, except in cases of manufacturing defects or our error (see §10–§11).

4) Product Information & Safety

We strive to display colors, materials, and sizing accurately, but variations may occur due to screens, lighting, and manufacturing batches. Safety: You are responsible for supervising your pet. Our products are not medical devices and do not replace veterinary advice. Always check fit and condition before each use; discontinue use if wear/damage is observed.

5) Orders & Acceptance

All orders are offers to buy. We may accept, reject, or cancel an order (e.g., inventory errors, suspected fraud, pricing mistakes). If we cancel after charging you, we will refund the full amount paid for the canceled item(s).

6) Pricing, Taxes & Promotions

Prices are shown in USD and may change without notice. Applicable sales tax and shipping are calculated at checkout. Promotions/coupons may be limited, non‑transferable, and not combinable unless stated.

7) Refund Method, Inspection & Timing

Inspection required. All returns are subject to inspection. If an item is not returned in new, unused, unwashed, hair‑free, unaltered condition with original tags/packaging, we may, at our discretion: (a) issue a partial refund reflecting the item’s condition and repacking costs, or (b) decline the refund and return the item to you; if so, you are responsible for return shipping.

Refund method & timing. Approved refunds are issued to the original payment method after we receive and inspect the return (usually within 5–10 business days from inspection). Bank or card‑issuer processing times may vary. Original shipping is non‑refundable (except where required by law).

8) Customization, Artwork & Proofs

Please review engravings, spellings, sizes, and options before checkout. If proofs are provided, you must approve them within 24–48 hours of our request; otherwise, we may proceed or cancel at our discretion. We are not responsible for errors submitted by the customer.

9) Returns & Exchanges (Non‑Custom Items)

You may request a return for eligible, non‑custom items within 14 days of delivery. Items must be new, unused, unwashed, hair‑free, and unaltered, with original tags/packaging. Returns are by mail only; no in‑person returns or pickups. Unauthorized returns (sent without approval/RMA) may be refused or not processed. Original shipping is non‑refundable (except where required by law).

Identity verification. To protect against fraud, return/exchange requests must be submitted from the order email or include proof of purchase (order number and shipping address).

How to start. Email hello@wagandsniffco.com within 14 days with your order number, the item(s), and reason/photos. If approved, we will issue an RMA and return instructions. Do not ship anything back without an RMA.

Sizing. If you chose the wrong size for a non‑custom item, we offer a one‑time exchange within 14 days if the item meets the condition requirements above; customer pays return and re‑shipment. If we shipped the wrong size/color, notify us within 7 days and we will correct it at our cost.

Restocking (non‑defective only). A restocking fee up to 10% may apply to non‑defective returns to cover inspection/repacking, excluding defective/wrong‑item returns (see §11), except where prohibited by law.

Design/style preferences. Not eligible for return or exchange.

10) Final Sale (Custom/Engraved Items)

Custom, personalized, and engraved products are final sale and not returnable or exchangeable, except for manufacturing defects or our error (see §11). Please review engravings, spellings, sizes, and options carefully before checkout. We engrave exactly what you submit and are not responsible for spelling or content entered by the customer.

11) Defects, Damage on Arrival (DOA) & Wrong Item

If an item arrives damaged/defective, or you received the wrong product, email within 7 days of delivery with: (a) order number, (b) clear photos/video of the product, inner/outer packaging, and the full, legible shipping label, and (c) a brief description of the issue. After review, we may provide a replacement, repair/part, or refund at our discretion. We will let you know if a return is needed and provide an RMA; do not return items without authorization.

Defect examples: broken hardware, torn seams on arrival, malfunctioning buckle/clip, engraving error made by us, wrong item/size/color compared to your order.
Exclusions: normal wear, misuse, chewing/biting, damage from improper fit, color variance due to screens/lighting, or carrier/customs delays.

Carrier delays; delivered‑not‑received. We do not accept returns based on carrier delays. If tracking shows “delivered” but you cannot locate the package, contact the carrier and email us within 3 business days of the delivery scan with any carrier case number you receive. 12) Chargebacks & Fraud

We investigate suspected fraud and may share evidence with payment processors, platforms, and law enforcement. Unauthorized chargebacks may be disputed.

13) Accounts; Communications

You are responsible for safeguarding your account credentials and for all activity under your account. By purchasing, you consent to receive transactional emails and, if you opt in, marketing emails/SMS (you may unsubscribe at any time).

14) Intellectual Property; User Content License

All Site content is owned by Wag & Sniff or its licensors and protected by intellectual property laws. By submitting reviews, photos, or other content, you grant Wag & Sniff a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display such content for marketing and Site operation, which you may revoke prospectively by written request where feasible.

15) DMCA / Copyright Agent

If you believe content on the Site infringes your copyright, send a notice compliant with 17 U.S.C. §512 to our DMCA Agent:

16) Prohibited Uses

You may not misuse the Site, interfere with its operation, attempt to breach security, scrape data, engage in automated purchasing, or use products in unsafe ways. We may suspend or terminate access for violations.

17) Disclaimers

No Veterinary Advice. Content is for informational purposes only.
AS IS / AS AVAILABLE. To the fullest extent permitted by law, the Site and products are provided “as is” and “as available.” We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.

18) Limitation of Liability

To the maximum extent permitted by law, Wag & Sniff will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

19) Arbitration Agreement; Class Action Waiver (U.S.)

Binding Arbitration. Any dispute or claim arising out of or relating to these Terms or your use of the Site or products will be resolved by final, binding arbitration administered by JAMS or AAA under their applicable consumer rules.
Venue & Seat: Ellis County, Texas (Waxahachie), unless both sides agree otherwise, or applicable law grants you the right to arbitrate near your residence.
Pre‑Arbitration Informal Resolution: Before filing, the initiating party must email the other a written Notice of Dispute with details and allow 30 days to resolve informally.
Governing Law: Texas law (without regard to conflict‑of‑law rules) and applicable U.S. federal law.
Small Claims: Either party may bring an individual action in small‑claims court.
Class/Representative Actions: Not permitted. You and we waive any right to a jury trial and to participate in class or representative actions.

20) Indemnification

You agree to indemnify and hold Wag & Sniff, its owners, and affiliates harmless from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or products, your breach of these Terms, or your violation of law or third‑party rights.

21) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., extreme weather, carrier disruptions, labor actions, epidemics, acts of government, power/network outages).

22) Changes to Terms

We may update these Terms at any time. Changes are effective when posted on the Site with a revised “Effective Date.” Your continued use after changes constitutes acceptance.

23) Severability; No Waiver; Assignment

If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce a right does not waive it. We may assign these Terms; you may not assign without our prior written consent.

24) Entire Agreement

These Terms, together with our Privacy Policy and any posted policies referenced here, constitute the entire agreement between you and Wag & Sniff regarding the Site and products.
